It is based on the premise that copyright protects a creative work, not something that is a straightforward fact. Thus a list of ingredients, especially for a traditional dish, is nothing more than a statement of fact. “These ingredients go into the pudding.” Even if we list them in the same order, which in today’s usage is generally stated in the order of use, it remains a statement of fact.
